Offshore companies registered in Dubai or Ras Al Khaimah may not enjoy benefits of bilateral agreements designed to prevent double taxation.
In order to enjoy the benefits, the company shall have the status of tax resident of the UAE.
The status of the resident company may be obtained by either a company incorporated in the main territory of the United Arab Emirates, or in one of the free economic zones and the company eligible for obtaining such certificate.
In case of free zone company . such company must be onshore one, have real office and director – resident of UAE. There may be some additional requirements as well.
Thus offshore company can not obtain tax residency certificate, but can obtain tax exemption certificate.
